Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Jobily platform, including our website at jobily.ca, mobile applications, and related services (collectively, the "Service") operated by Jobily Technologies Inc. ("Jobily", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using any part of the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you may not access or use the Service.
We may update these Terms from time to time. We will provide notice of material changes by email or prominent notice on the Service at least 30 days before the changes take effect. Your continued use after the effective date constitutes acceptance of the revised Terms.
2. Eligibility
To use the Service, you must:
- Be at least 18 years of age, or the age of majority in your province or territory if higher;
- Have the legal capacity to enter into binding contracts under applicable Canadian law;
- Not be barred from receiving services under the laws of Canada or any applicable jurisdiction;
- Provide accurate and truthful information when creating your account.
Employer accounts must be registered by an authorized representative of a legally constituted business entity operating in Canada.
3. Account Registration
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:
- Provide accurate, current, and complete registration information;
- Update your information promptly if it changes;
- Notify us immediately at security@jobily.ca of any unauthorized account access;
- Use a strong, unique password and enable two-factor authentication where available.
Jobily is not liable for any loss or damage arising from your failure to protect your account credentials. We reserve the right to terminate or suspend accounts that we reasonably believe have been compromised.
4. Permitted Use
The Service is provided solely for legitimate job search, recruitment, and workforce management purposes. You agree not to:
- Post false, misleading, or fraudulent job listings or candidate profiles;
- Scrape, crawl, or systematically extract data from the Service without express written authorization;
- Use automated tools, bots, or scripts to access or interact with the Service;
- Circumvent, disable, or interfere with security features of the Service;
- Transmit viruses, malware, or other harmful code;
- Use the Service to send unsolicited commercial communications (spam);
- Collect or harvest personal information about other users without their consent;
- Impersonate any person, company, or entity;
- Use the Service in any manner that violates applicable Canadian law, including the Criminal Code, the Canadian Anti-Spam Legislation (CASL), or human rights legislation.
5. Job Seeker Terms
By using the Service as a job seeker, you acknowledge that:
- You are solely responsible for the accuracy of information in your profile and applications;
- Misrepresenting your qualifications or experience may result in immediate account termination;
- Jobily does not guarantee employment or interviews as a result of using the Service;
- Job listings are provided by third-party employers and Jobily is not responsible for the accuracy of such listings;
- When you apply to a job, your application and relevant profile data are shared with the posting employer;
- You must comply with all applicable work authorization requirements in Canada.
6. Employer Terms
Employers using the Service agree to:
- Post only genuine, currently open positions at a legitimate business entity;
- Comply with all applicable employment laws, including the Employment Standards Act (Ontario) and its provincial equivalents, the Canadian Human Rights Act, and pay equity legislation;
- Not discriminate against applicants based on any protected ground under applicable human rights legislation;
- Handle candidate personal data in accordance with PIPEDA and applicable provincial privacy legislation;
- Not use candidate information for any purpose other than evaluating their application for the posted position without their explicit consent;
- Remove job postings within 5 business days of a position being filled or closed;
- Complete company verification within 30 days of account creation.
Jobily reserves the right to remove any job posting that violates these Terms or our content policies, without notice and without refund.
7. Payments and Billing
Paid features are subject to the following terms:
- All fees are quoted and charged in Canadian dollars (CAD) and are inclusive of applicable HST/GST where required;
- Subscription plans renew automatically unless cancelled before the renewal date;
- You authorize Jobily to charge your payment method on file for recurring fees;
- Refunds are governed by our Refund Policy, available at jobily.ca/contact;
- Jobily may change pricing upon 30 days' written notice. Continued use after the notice period constitutes acceptance of the new pricing;
- Disputed charges must be raised within 60 days of the billing date.
Payment processing is handled by Stripe Payments Canada, Ltd. in accordance with their terms of service. Jobily does not store full payment card numbers.
8. Intellectual Property
All content, features, and functionality of the Service ”” including but not limited to text, graphics, logos, icons, AI models, software code, and the Jobily brand ”” are owned by or licensed to Jobily Technologies Inc. and are protected by Canadian copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purposes. This licence does not include any right to:
- Reproduce, distribute, or create derivative works from Service content;
- Reverse-engineer, decompile, or disassemble any part of the Service;
- Use Jobily's trademarks or branding without prior written consent.
9. User Content
You retain ownership of any content you submit to the Service ("User Content"), including your profile, resume, and job postings. By submitting User Content, you grant Jobily a worldwide, royalty-free, non-exclusive licence to host, store, display, and process your User Content solely as necessary to provide and improve the Service.
You represent and warrant that your User Content: (a) does not infringe any third-party intellectual property rights; (b) does not contain defamatory, obscene, or unlawful material; and (c) complies with all applicable laws.
Jobily does not use User Content to train AI models. See our Privacy Policy for details.
10. Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Jobily is committed to handling your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Jobily does not warrant that: (a) the Service will be uninterrupted or error-free; (b) job listings are accurate, complete, or current; (c) AI-generated match scores or recommendations will result in employment; or (d) the Service is free of viruses or other harmful components.
To the maximum extent permitted by applicable law, Jobily expressly disclaims any responsibility for the conduct of employers or job seekers on the platform.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL JOBILY, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
Jobily's total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the amounts paid by you to Jobily in the 12 months preceding the claim; or (b) one hundred Canadian dollars (CAD $100).
Some jurisdictions do not allow exclusion of implied warranties or limitation of liability, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Jobily Technologies Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in any way connected to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party right.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Ontario, Canada. If a dispute cannot be resolved through negotiation, the parties agree to attempt mediation before commencing litigation.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
